1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and DoseCompare, a service operated by Outport AI ("DoseCompare," "we," "us," or "our") governing your use of the DoseCompare.com website and all related services (collectively, the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Site immediately.

2. Nature of the Service - Informational Directory Only

DoseCompare is an independent informational directory and comparison resource that aggregates publicly available information about GLP-1 medication providers. The Site is intended solely to help consumers research and compare third-party providers of GLP-1 weight loss medications.

DoseCompare is NOT a healthcare provider, medical practice, pharmacy, telehealth service, or insurance broker. DoseCompare does NOT:

• The quality, licensure, legal compliance, credentials, or practices of any listed third-party provider

DoseCompare is not a party to and shall not be liable for any transactions, communications, or disputes between you and any Third-Party Service. Before using any Third-Party Service, you should independently verify credentials, licensure, pricing, and terms of service.

6. Affiliate Relationships

DoseCompare participates in affiliate programs with certain Third-Party Services. When you click an affiliate link and sign up with, purchase from, or subscribe to a Third-Party Service, DoseCompare may receive a commission or referral fee at no additional cost to you. Drug brand names (including but not limited to Ozempic, Wegovy, Mounjaro, Zepbound, Saxenda, Rybelsus, Trulicity, and Victoza) are trademarks of their respective manufacturers and are used on the Site solely for informational identification purposes. DoseCompare is not affiliated with, endorsed by, or sponsored by any drug manufacturer.

9. Assumption of Risk

You acknowledge and agree that healthcare decisions - including decisions about medications, providers, insurance, and treatment - carry inherent risks. You voluntarily assume all risk associated with your use of the Site and any reliance on Content. You acknowledge that no information on the Site has been individually tailored to your medical history, current health status, or other personal factors that a licensed healthcare professional would evaluate.

10. DISCLAIMER OF WARRANTIES

THE SITE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR FREEDOM FROM COMPUTER VIRUSES. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DOSECOMPARE DISCLAIMS ALL WARRANTIES. DOSECOMPARE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

11. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DOSECOMPARE, OUTPORT AI, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DAMAGES FOR:

• Personal injury, bodily harm, or wrongful death
• Medical expenses, insurance denials, or uncovered treatments
• Adverse reactions to any medication discussed on the Site
• Financial loss, lost profits, lost revenue, or lost business
• Loss of data or inability to use the Site
• Emotional distress or mental anguish
• Any decision made based on information found on the Site

THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTORY LIABILITY, OR ANY OTHER BASIS, EVEN IF DOSECOMPARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOSECOMPARE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DOSECOMPARE DURING THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00 USD).

12. Indemnification

You agree to indemnify, defend, and hold harmless DoseCompare, Outport AI, and their respective officers, directors, employees, contractors, agents, licensors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use or misuse of the Site
• Your violation of these Terms
• Your violation of any third-party right, including intellectual property, privacy, or publicity rights
• Your medical, healthcare, financial, or purchasing decisions
• Any dispute between you and any third-party provider
• Your negligent, reckless, or willful conduct

13. Governing Law and Jurisdiction

These Terms and any dispute arising from your use of the Site shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. You agree that any legal action or proceeding shall be brought exclusively in the provincial or federal courts located in Ontario, Canada, and you consent to the personal jurisdiction of such courts.

14. Dispute Resolution

Before initiating any formal legal action, you agree to attempt to resolve any dispute with DoseCompare informally by contacting us at legal@dosecompare.com with a detailed description of your concern. We will make good-faith efforts to resolve the dispute within 60 days of receipt.

15. Age Restrictions

The Site is not intended for use by individuals under 18 years of age. By using the Site, you represent and warrant that you are at least 18 years old. If you are under 18, do not use the Site.

16. Modifications

We reserve the right to modify these Terms at any time in our sole discretion. Changes will be effective upon posting to the Site with a revised "Last updated" date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

17. Termination

We reserve the right to suspend or terminate your access to the Site at any time, with or without notice, for any reason or no reason, including violation of these Terms. Upon termination, all provisions of these Terms that by their nature should survive (including Sections 3, 9, 10, 11, 12, 13, and 14) shall survive.

18. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and DoseCompare regarding your use of the Site and supersede any prior agreements.
